TERMS AND CONDITIONS

Be:Devoted Silver Studio Membership

Monthly Fee:  £100 / month

Subscription Term: 12 months

Be:Devoted Silver Studio Membership is a 12 month subscription package.  By subscribing to this membership you agree to the terms and conditions outlined on this page.

  

1. Your Member Benefits

Your membership includes the following items as part of the subscription package:

  • Upto 8 Group Class Credits each month that can be used for both group mat class and group apparatus classes

  • 20 % discount on private bookings such as 1:1s and private duets, trios or groups, as well as an additional group class credits you may wish to purchase

  • Online access to the Be:Poised Pilates members library of pre-recorded mat class videos

Additional Member Benefits:

  • Advance booking for group mat and group apparatus classes

  • A 10% discount on workshops and special events

  • Access to members only special events run by Be:Poised Pilates Ltd

Be:Poised Pilates Ltd reserves the right to amend additional member benefits in accordance with business needs.  In the event of changes to member benefits, Be:Poised Pilates Ltd will communicate these changes to existing members at least 30 days in advance of the changes being implemented where reasonably possible to do so. 

The availability of certain membership benefits might be affected by events outside of the company’s reasonable control. In such situations Be:Poised Pilates Ltd shall make reasonable efforts to limit the effect of any of those events and keep members informed of the circumstances. Examples of events which might be beyond the company’s reasonable control include illness, pandemics, epidemics, IT issues and problems with hosting providers, any law or action taken by a government or public authority.  In the event that membership resources are not available in whole or in part at any time, Be:Poised Pilates Ltd shall have no liability in any circumstances.

In order to gain access to the on demand resources in the members video library you will need a computer, tablet or smartphone with internet connection and working audio.  Members are responsible for ensuring they have the correct equipment and that any necessary software is kept up to date.

The resolution and quality of the online resources you receive will depend on a number of factors, including the type of device you are using and your bandwidth, which may fluctuate during the course of your viewing. Whilst Be:Poised Pilates Ltd uses all reasonable endeavours to provide a quality viewing experience, no guarantee can be made as to the resolution or quality of the content you will receive.

 

2. Group Class Credits: 

Group Class credits are valid for any of the following classes:

  • Group Pilates Mat Classes:  Includes Classical Pilates Mat, Strong Foundations Mat, Pilates for Pregnancy Mat Class and Mum & Baby Friendly Mat class.

  • Group Pilates Apparatus Classes

Classes must be booked in advance.  Class size limits apply and attendance is subject to space being available in the class at the time of booking.  For classes that are fully booked, use of the waiting list function is recommended.  If a class member cancels their booking and you are on the waiting list you will automatically be notified that a space has become available and given the option to book.   Members have early access to class bookings compared with non-members.  Members are responsible for managing their own bookings. 

Late Cancellations and No Shows:  The standard Be:Poised Pilates Ltd cancellation policy applies to all bookings made with your membership.  Late cancellations and no shows will be charged in full and the credit will not be returned to your pass.    A late cancellation is defined as a group class cancellation made less than 6 hours before the start time of the class.  A no show is defined as a booking for a class that the member did not turn up to and no cancellation was made. 

Exclusions: The following are not included within your Silver membership group class pass:

  • Private sessions, including 1:1s and private duets, trios and groups. 

    • Members are able to book private sessions at an additional cost.  Members receive a 20% discount on all private sessions (automatically applied within the booking system)

  • Workshops and special events

    • Members are able to book workshop and event tickets at a special member rate that includes a 10% discount compared with the standard ticket price.  A discount code is required at checkout. 

Unused Credits:  Each membership month you will be issued a new pass consisting of 8x group class credits.

Your membership is for upto 8 group class attendances per month.  As a good will gesture giving flexibility to book ahead and/or use any unused credits for extra catch up sessions, each pass has been set with a validity period of 2 months instead of 1. 

Silver membership is calculated based upon an average of upto 2 sessions per week over the period, with the price adjusted to account for planned studio closures and a generous contingency for staff absence and any unforeseen class cancellations over the full 12 month period.  No additional carry over of credits, refunds or other adjustments will be made for unused credits at the end of the pass validity period.

 

3. Fees and Payment: 

Be:Devoted Silver Studio Membership is a 12 month subscription package, payable in 12 monthly instalments of £100 per calendar month.    Your first payment will be taken on the start date of your membership.  You will continue to be charged on a monthly basis for the duration of the 12 month subscription.

Payments are managed via the BSport booking platform.  You are responsible for ensuring your payment details are kept up to date for the duration of your membership term.

The membership fee is calculated taking into account planned studio closures and a generous contingency for staff absence and unforeseen class cancellations over the full 12 month period.  The package price is then divided into 12 equal sums that are charged on a monthly basis over the course of the period.   Therefore no adjustments, pauses or refunds will be given for months in which members have attended less classes than usual due to studio closures, class cancellations or their own personal circumstances such as holidays and illness. 

 

4. Managing your membership.

Be:Devoted Silver Studio Membership is a fixed 12 month term subscription.  When subscribing to the membership you are agreeing to remain in a member for the full duration of the membership period. 

Pausing your membership:  In very exceptional circumstances the studio may agree to pause your membership for a defined period of time.  Examples may include significant surgery such as joint replacements where you are advised to rest for a defined period of time that is more than 1 month.  Requests to pause membership should, where possible, be made in writing to Be:Poised Pilates in advance of the required start date of the membership pause.  If agreed your membership will be paused from the end of the current billing month.  Retrospective adjustments for weeks missed cannot be made.    Your member benefits will not be available to you whilst your membership is paused.

Cancelling your Membership:  Your membership subscription is for a set 12 month term.  Your subscription will automatically come to an end at the end of the 12 month.  If you choose to cancel your membership early your monthly payments will continue to be processed until the end of the subscription term and you will be liable for any overdue sums.   Only in very exceptional circumstances may early termination be possible without incurring future payments.  Requests for early termination must be made in writing to Be:Poised Pilates Ltd stating the reason for termination.    Membership fees are non-refundable.  No refunds will be given for months that have already been billed.

Renewing your Membership:  Be:Devoted Silver Membership is a 12 month subscription.  At the end of the 12 month period your membership will come to an end.  No further payments will be due and all member benefits will cease.  To continue to receive your membership benefits you will need to sign up to a new membership package, or select to Auto-renew within your BSport user profile.

 

5. Your responsibilities

You will pay the fees for the membership in accordance with the terms set out in this document. 

Membership sign up is via the BSport platform, available on the Be:Poised Pilates website and via the BSport App.  Use of the BSport platform is subject to platform terms and conditions, which you will be asked to accept upon registration.

Strictly no sharing of login details, downloading, recording, copying or otherwise sharing of member content. You may not share, give or sell your login details or member content to any other person or entity. Excessive viewings or logins by any member, or evidence of unauthorised copying of content may be treated as fraudulent use of the membership, in which case it will result in the immediate cancellation of membership without refund. When you become a member, you agree to take all reasonable actions possible to protect your login details from fraudulent use. Be:Poised Pilates Ltd reserves the right to cancel any membership believed to have been compromised, or being used fraudulently, at its sole discretion.

The membership is not suitable for persons under 18 years of age, and by signing up you confirm that you are eighteen 18 years of age or older.

If you are currently receiving treatment from a doctor or other healthcare professional, by agreeing to these terms and conditions and signing up for the membership, you confirm that you have consulted with the person treating you regarding the advisability of signing up for my membership and that this person is aware of and supports your decision to proceed with the membership.

The resources in the membership do not in any way constitute specific advice or recommendations. They are for training and guidance only.

Physical exercise, in all of its forms, can be a strenuous physical activity. You are therefore advised to seek the advice of your GP before beginning any physical exercise program, including using the resources and following the videos in the membership.  By using the resources in the membership, you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by following the videos and other resources in the membership, you will not exceed your limits while performing such activity, and you will select the appropriate level of activity for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time teachers may suggest physical adjustments, or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.

You should never delay seeking medical advice, disregard medical advice or discontinue medical treatment because of information in the membership.

It is important to realise that you should stop whenever you wish, especially if you feel tired or any discomfort. None of the exercises should cause you to experience any pain. If you should experience any pain from any of the exercises, you should stop the exercises immediately.

Always seek the advice of your GP if you are experiencing mental health difficulties and discuss with a qualified health professional before making any changes to existing psychological treatment. Practising relaxation exercises is not recommended for persons experiencing active post-traumatic stress disorder (PTSD) or major trauma. Do not undertake any Mindfulness or relaxation content if this applies to you. Never participate in relaxation and mindfulness exercises whilst driving or operating machinery.

Be:Poised Pilates Ltd may terminate your membership early if you commit any material breach of the terms of this contract. If Be:Poised Pilates Ltd terminates your membership and suspends or discontinues your access due to your breach of this contract, then you will not be entitled to any credit, refund or discount in relation to the membership fees already paid by you.

 

6. Intellectual property

Any materials provided to you, whether digital or printed, any intellectual property in those materials belongs to Be:Poised Pilates Ltd and unless specifically agreed otherwise you can only use those materials for your own personal use and you may not share them with third parties.

The resources in the membership are provided for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever.

From time to time Be:Poised Pilates Ltd may record live sessions that are made available to you through the membership. If you participate in such sessions, you authorise Be:Poised Pilates Ltd to use your image and voice in any such recordings (and to make use of such recordings in any way fit) without payment, other condition or need for further consent.

 

7. Personal information

Be:Poised Pilates Ltd shall use the personal information you provide to provide the membership and process your payments for the membership.

8. Limit on responsibility to you

Except for any legal responsibility that cannot be excluded in law (such as for death or personal injury caused by negligence), Be:Poised Pilates Ltd is not legally responsible for any losses that were not foreseeable when the subscription was activated or that were not caused by any breach of these terms on the company’s part. Be:Poised Pilates Ltd is not legally responsible for any business losses, including loss of business, business interruption, loss of profits, loss of management time and loss of business opportunity. Total liability to you is limited to the amount of fees paid by you for the membership services and you confirm your understanding that the price of membership is calculated bearing in mind this limit on liability.

Be:Poised Pilates Ltd reserve the right to make changes to the membership from time to time. The availability of the content, as well as platforms and compatible devices, may change from time to time. The company also reserves the right to replace or remove any resources and the platforms available to you through the membership, and to otherwise make changes in how the membership is operated.   Be:Poised Pilates Ltd may from time to time, with respect to any or all members offer certain features or other elements of the membership, including promotional features, user interfaces, plans, pricing, and advertisements.

 We will give you written notice (via e-mail) of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of the membership from the date that we give you such notice; if you do not agree to the revised terms and conditions, you must stop using the membership and cancel your subscription.

In the unlikely event that there is a problem with the membership, please contact Be:Poised Pilates Ltd as soon as possible with a reasonable opportunity to sort out any problems with you and reach a positive outcome.
